1. Nature of the Service — What We Are and Are Not

What we are

• A provider of calculation-tool software and AI assistants for building and structural work
• Tools that help professionals work faster

What we are not

• Not a provider of controlled professional engineering services under the law, and not acting as your design engineer or the certifier of your designs
• Not a consultant responsible for the design
• Not the decision-maker — we do not determine whether any design is safe or usable
• Not a representative or delegate authorized to sign off on any work

Use of this Service does not create an engineer–client relationship or any professional relationship between us and you.

2. User Duties and Responsibilities

By using the Service, you represent and agree that:

• You will verify the accuracy of all inputs and results every time using your own professional judgment
• You will have a licensed engineer of the appropriate discipline and level for the work review and certify the results before they are put to actual use
• You understand that results may contain errors, and using them without verification may cause serious harm, including loss of life
• You are responsible for compliance with all applicable laws, ministerial regulations, standards, and local ordinances
• You are responsible for the correctness of the assumptions, units, constants, and boundary conditions you enter into the system
• You alone are responsible for the outcome of all decisions

3. No Warranty of Accuracy of Results

The Service is provided "as is" and "as available", with no warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.

In particular:

• AI results may be wrong, inaccurate, or fabricated (hallucination) even when they appear reasonable
• Calculation tools may have limitations, hidden assumptions, or program errors
• Standards data and reference values may be out of date or not match the edition in force in your area
• We do not warrant that the Service will be uninterrupted or error-free

4. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any damages arising from the use of, or inability to use, the Service, including direct, indirect, incidental, consequential, or punitive damages
• We are not liable for damage to structures or property, injury, or death arising from the use of results
• We are not liable for loss of profits, revenue, data, reputation, or business opportunities
• Our total aggregate liability, in any case, is limited to no more than the fees you actually paid us in the 12 months before the event giving rise to the claim

This limitation applies even if we have been advised of the possibility of such damage, and does not exclude any rights that the law provides cannot be limited.

5. User Accounts

• You must provide accurate information and keep your password confidential
• You are responsible for all activity that occurs under your account
• Do not share your account with others — one account per user
• You can delete your account at any time at /account/delete (see details in the Privacy Policy, section 8)

6. Fees and Refunds

• Fees are charged on a recurring subscription basis, billed automatically until cancelled
• You can cancel at any time — it takes effect at the end of the current billing cycle, and you can keep using the Service until then
• Fees already paid are non-refundable, unless the law requires otherwise or we decide otherwise on a case-by-case basis
• We may change prices, giving reasonable advance notice before they take effect for the next billing cycle
• Usage quotas (such as AI tokens or number of images) follow the specified plan and do not roll over between cycles

7. Acceptable Use

You must not:

• Use the Service for unlawful purposes or to infringe the rights of others
• Attempt to hack the system, bypass authentication, bypass quota limits, or disrupt the operation of the Service
• Automatically scrape data, reverse-engineer, or copy any part of the Service to build a competing service
• Resell or provide the Service onward without written permission
• Upload content that infringes copyright, or other people's personal data that you have no right to
• Use the results in a way that misleads others into believing they have received professional certification from us

8. Intellectual Property

• The software, user interface, trademarks, and content of the Service are ours
• The data and content you enter remain yours — we request only the rights necessary to provide the Service to you
• The results the system produces for you may be used in your own work, subject to these Terms
• We claim no ownership of your drawings or designs

9. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, use the Service in a manner harmful to the system or other users, or fail to pay fees. Where reasonably practicable, we will notify you beforehand.

We may discontinue or change parts of the Service, giving reasonable advance notice.

10. Changes to These Terms

We may amend these Terms. If the change is material, we will notify you via the website or email. Continued use of the Service after the change means you accept the new Terms. If you do not accept them, please stop using the Service and delete your account.

11. Governing Law

These Terms are governed by Thai law, and the Thai courts have jurisdiction. If any provision is void or unenforceable, the remaining provisions continue in full force and effect.
